Smartphones Application “My Bakery”

Terms and Conditions (“Terms”)

1. INTRODUCTION: Welcome to our My Bakery application (the “App“). This App is published by or on behalf of A. Zorbas & Sons Ltd (“We” or “Zorbas”) a company registered in Cyprus under registration number 13138 whose registered office is situated at Armenias, 51, Strovolos, Nicosia, Cyprus. By downloading or otherwise accessing the App you agree to be bound by the following terms and conditions (“Terms“) and our privacy policy (“the Privacy Policy”). 2. ACCESS OF APPLICATION AND ZORBAS WEBSITE/PORTAL: Access to the App and Zorbas website (the “Website”) is free. The App can be installed on more than one smartphones. By downloading and accessing the App and the Website you unconditionally agree to the Terms and to our Privacy Policy; please read both carefully.
3. NATURE OF APPLICATION: The App behaves similarly to a reward card for purchases in Zorbas stores by using at all times an internet connection. By installing the App into your smartphones you can receive cashback by scanning at the till your bar code. In order to be able to receive reward awards or cash back awards from reward offers or spend awards, the bar code needs to be presented at all times at any tills available at Zorbas stores. A prerequisite for the usage of the App is that your smartphones is duly connected to an Internet connection otherwise you will not be able to use the App at the time to receive cashback awards. The App is valid only at Bakeries-Confectioneries “ZORBAS”. Zorbas maintains the right of rejecting the downloading/installation or staying the use of My Bakery, terminating or amending the benefits program of My Bakery at any time and provide the appropriate notification to the holders/users. The holders/users of My Bakery will earn 1% (one per cent) on the total amount of the purchase in one till receipt (valid for a minimum purchase amount of 0,51€) and the reward amount will be entered into the digital wallet of the holder. Reward amounts will be entered in each visit. There is no minimum redemption amount of reward. The minimum limit can be changed at any time by Zorbas. My Bakery can be used in all stores of Zorbas in Cyprus which participate at this customer benefits program of Zorbas.
4. AGE LIMIT: For a Customer to be able to participate to the benefits program of the My Bakery he/she must be 18 years old and above.
5. USAGE OF APP: Your My Bakery App and account cannot be used as credit card or a cheque guarantee card.
6. REDEMPTION OF REWARD AMOUNTS: To redeem reward amounts the bar code of My Bakery App must be presented to the participating stores of Zorbas and at the cash registers before each purchase is made. Please note the payment for purchase can be carried out partly in cash and partly by redeeming reward amount.
7. TRANSFER OF REWARD AMOUNTS: The transfer or conveyance reward amount between accounts of the App is not permitted.
8. REWARD VOUCHERS: The Reward Vouchers and/or reward amounts of the App cannot be exchanged for cash or by giving/returning change. The Reward Vouchers will be valid only for a specific period of time from the date of issue.
9. DELETION OF REWARD AMOUNTS: Zorbas reserves the right to delist/delete the reward amount to each My Bakery account that is not active for at least 12 (twelve) months.
10. PROCESS OF PERSONAL INFORMATION: Holders/Users of My Bakery App will need to provide personal or other information in application forms or to any other form of communication with Zorbas for the creation of an account. Whenever the unique bar code of the App is used by the holder/user or whenever any data of the transactions and usage of My Bakery are provided, the details of the transaction will be recorded in records. Any of this information can be used by Zorbas and/or their employees and/or representatives thereof when necessary for the operation of the benefits program My Bakery in order to redeem reward amounts which have been collected or concentrated on My Bakery or to prevent abuse of the benefits program. Information on specific products or services which will be bought by the holder and user from Zorbas will be analysed and managed by Zorbas when necessary for the operation of the Benefits program My Bakery. The stores ‘Zorbas’ of Zorbas of which the App will be used to collect the reward amount and return money or redeem transaction, may use information about the specific products or services purchased to notify the holder of My Bakery on offers or to update the data record in which the holder of My Bakery is already registered following his/her consent. Any data related to specific products or services (for example, the total refund collected each month from your purchases) can be processed and analysed by Zorbas, as to where and how you use the App and may be registered in the records of Zorbas for processing and in order to ensure a better trading relationship with you. Zorbas may use the contact details supplied by to it by the holder for the aforementioned purposes as well as for informing them from time to time at its absolute discretion about products, services, conditional offers, competitions. For a full explanation on which data will be collected and how they will be utilized please read carefully our Privacy Policy; by accepting the Terms you also fully accept the Privacy Policy.
11. COMPATIBILITY: The App is designed to be compatible with the specified version of the mobile operating systems Android 6.0, iOS 9.3.1and Windows Universal 8.1 and upper.
12. WEBSITE CONTENT: All content published on the Zorbas.com.cy domain belongs exclusively to Zorbas. Content from Zorbas.com.cy web site shall not be used or exploited for any commercial and non-private purposes without the prior written consent of Zorbas.
13. GENERAL RULES RELATING TO CONDUCT: The App is made available for your own, personal use. The App must not be used for any commercial purpose whatsoever or for any illegal or unauthorized purpose. When you use the App you must comply with all applicable Cyprus laws and with any applicable international/European laws (together referred to as “Applicable Laws”). By using the App you agree that you will fully comply with all Applicable Laws as well as these Terms. Specifically, but without limitation and prejudice to the rights of Zorbas you agree not to (a) use the App in any unlawfully manner or in any way which promotes illegal activity including (without limitation) copyright infringement; or (b) attempt to access without authorization the App or any networks, servers or computer systems connected to the App; or (c) adapt, translate, modify, tamper, infringe, any part of the App or the pages comprising the App; (d) translate the App into other languages, or make derivative versions. By installing the App you agree to indemnify Zorbas and its group companies in full and on demand from and against any loss, damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of the App otherwise than in accordance with these Terms or Applicable Laws. Zorbas reserves the right of disabling your account or your access to the App and the website of Zorbas in case of abuse of the App or the website of Zorbas or any other users.
14. CONTENT: The App and all the trademarks, signs, logos, service marks and other intellectual property (“Trademarks”) related to it are the sole property of Zorbas. The copyright in all material contained on, in, or available through the App including all information, data, text, music, sound, photographs, graphics and video messages, the selection and arrangement thereof, and all source code, software compilations and other material (“Material“) is owned by or licensed to Zorbas or its group companies. All rights are reserved. By installing the App you agree that you will not otherwise copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Material and the Trademarks without Zorba’s express permission or the relevant third party partner of Zorbas.
15. LINK TO THIRD PARTIES: The App may contain links to websites operated by third parties (“Third Party Websites“). Zorbas does not have any influence or control over any such Third Party Websites unless expressly stated and, unless otherwise stated, is not responsible for and does not endorse any Third Party Websites or their availability or contents.
16. REQUESTED INFORMATION: For you to be able to use the App through your smartphones as well as access your account information through the website of Zorbas you will need to provide Zorbas with your personal information such as your email address and mobile number. The provision of the said personal data is necessary and is needed to ensure the operation of the Benefits program My Bakery and the security of your account. By installing the App and inserting your information on Zorbas’ Website you will have the opportunity of viewing your awards, spend transactions, balance and receive notifications as you agree from time to time. In order to be able to install the App to your smartphones as well as access your account through Zorbas’ Website you will need to have/insert a valid email address and a password.
17. ZORBAS PRIVACY POLICY: Zorbas will only use your personal information in accordance with the present Terms and of our Privacy Policy. By using the App you acknowledge and agree that you have read and accept the terms of our Privacy Policy.
18. DISCLAIMER / LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) ZORBAS DISCLAIMS ALL LIABILITY WHATSOEVER, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE IN RELATION TO THE APP; AND (B) ALL IMPLIED WARRANTIES, TERMS AND CONDITIONS RELATING TO THE APP (WHETHER IMPLIED BY STATUTE, COMMON LAW OR OTHERWISE), INCLUDING (WITHOUT LIMITATION) ANY WARRANTY, TERM OR CONDITION AS TO ACCURACY, COMPLETENESS, SATISFACTORY QUALITY, PERFORMANCE, FITNESS FOR PURPOSE OR ANY SPECIAL PURPOSE, AVAILABILITY, NON INFRINGEMENT, INFORMATION ACCURACY, AS BETWEEN ZORBAS AND YOU, HEREBY EXCLUDED. IN PARTICULAR, BUT WITHOUT PREJUDICE TO THE FOREGOING, WE ACCEPT NO RESPONSIBILITY FOR ANY TECHNICAL FAILURE OF THE INTERNET AND/OR THE APP; OR ANY DAMAGE OR INJURY TO USERS OR THEIR EQUIPMENT AS A RESULT OF OR RELATING TO THEIR USE OF THE APP.. Zorbas will not be liable, in contract, tort (including, without limitation, negligence), under statute or otherwise, as a result of or in connection with the App, for any: (i) economic loss (including, without limitation, loss of revenues, profits, contracts, business oranticipated savings); or (ii) loss of goodwill or reputation; or (iii) special or indirect or consequential loss.
19. SUSPENSION: Zorbas fully reserves the right to suspend or cease providing any services relating to the apps published by it, and shall provide a reasonable notice for such cease.
20. ADVERTISERS IN THE APP: We accept no responsibility for adverts contained within the App nor we are affiliated with adverts. If you agree to purchase goods and/or services from any third party who advertises in the App, you do so at your own risk; if you have any queries or complaints in relation to them, please contact the advertiser directly.
21. COMPETITIONS: If you participate in any competition applicable through the App (“Competition”) you agree to be bound by the rules of the Competition and/or any other rules which might be specified by Zorbas from time to time. Zorbas reserves the right to disqualify any entrant or user and/or winner in its absolute discretion.
22. IN-APP VOUCHER CODES: Any in-app voucher codes issued by Zorbas may only be used in accordance with our terms and conditions as specified by Zorbas.
23. GENERAL: These Terms (as amended from time to time) constitute the entire agreement between you and Zorbas concerning your use of the App. Any decision of Zorbas concerning the operation of the Benefits program My Bakery and/or the App and the interpretation of the present terms and conditions shall be final and binding on all holders and users of My Bakery. Zorbas may cancel, revoke or modify the Benefits program and My Bakery and/or the App and these Terms and Conditions or any account My Bakery and give proper notice to the holders/users. Zorbas reserves the right to proceed with any action or measure deems appropriate, if it considers that there is suspicion of abuse of the Benefits program or My Bakery and/or the App and/or any account of the App and/or its website or the related promotions and offers.
24. MODIFICATIONS OF DATA AND CONTACT ZORBAS: In the case which you wish to correct or modify the data on the records of Zorbas or cancel My Bakery and delete data from the records of Zorbas you can do so by sending an email to [email protected] or by calling at 80000600.
25. GOVERNING LAW: These Terms and the Privacy Policy are governed by Cyprus law, and exclusive jurisdiction on any matter relating to them will have the proper Cyprus Courts.
